You're getting hung up on my earlier semantic mistake .. it doesn't matter if the definitions are from a subheading of Electronics > Used > [Category], those category descriptions still stand no matter that I didn't see they were from a subheading, they're still the right descriptions and the the item doesn't fit the one the seller chose, so it was misrepresented.
I'm not, I'm just pointing out that Graeme has missed that, there's no use him complaining about a groundless point.

I agree he shouldn't be listing it as "Used - like new" but that's exactly how the listings appear and that's all I'm clarifying.

UPDATE

According to my daughter she's checked the listing on Amazon and can see nothing that suggests the drive is being sold as used, she emailed him back pointing this out & that it was misrepresented etc and he agreed to return the money without any argument.

I'm gonna have a look at the listing myself when I get a chance and I'll post the link here later, but it now looks to me judging by the perfect packaging and the price he's tried to pass this off as a new drive (probably an attempt to offset the cost of his shiny new 480gb ssd) and simply made a schoolboy error by forgetting to wipe it clean.

If he had wiped it clean I would have had no reason whatsoever to suspect this was anything other than a brand new drive,

As I said before, it'll be in her confirmation email when she made the order, easy enough to check that.

According to my daughter (Angela) there is nothing on the listing or the confirmation email suggesting it's used, anyway here's the emails sent back and forward

Dear Sir/Madam,

I received this drive today. I had assumed this was a new drive and although it was packaged and sealed as new there is an operating system installed on it already with details of the previous owner (name, email address etc.)

Can you please confirm if this drive should have been new or if I missed that this was used on the description? Any help would be appreciated.

Yours faithfully,

Angela Duncan

Dear Ram,

Thank you for your reply. I am however unsatisfied with the description of this drive and feel that the sale was misrepresented. I have since looked at the drive and have discovered this has been run for 512 hours, which cannot be described as like new, especially as you've stated it was used only once!  Furthermore, there is pornography on this drive with details of the previous owner.

I am very disappointed as this was the same price as a brand new drive, leading me to believe it was! In addition, it arrived packaged as a new drive.

I look forward to your reply and how we progress from here, otherwise I will contact Amazon directly to receive resolution.

Yours sincerely,

Angela Duncan

Dear Ram,

I would like to return the drive, however I do not want to be out of pocket for postage. I am exceptionally frustrated that I am having to do this in the first place.

How do I go about returning this to you?

Yours,

Angela

I am afraid; I don't have paypal account to pay. Can I collect the drive from your address and I can do the full refund of the order via Amazon? Is that Ok with you? Alternatively, I can do the full refund including the postage via Amazon upon receiving the drive if you post that to me in special delivery.I can get that drive within next day if you post in Special Delivery.

I am not at home at the moment, I will send you my bank details for postage payment when I get home. It is not convenient to pick it up from here, I am in Dundee and may not be home. I am not sure if I will be able to take this to a post office tomorrow but I know I can on Wednesday. I do not know what the postage cost will be however. This could have been avoided if your advert was accurate.

Apologies for that. I will definitely pay you the total amount including the postage as soon as I receive the item back. Special Delivery would cost 6-7 which I will bear on behalf of you. If you post it tomorrow, I will receive that by Wednesday. I can do the full refund on the same day.

OK, none of those is the confirmation email from Amazon. Under Condition it has to say New, Refurbished, Used, or whatever.

Yes I know I will get her to forward it to me and post it later I don't want to pester her too much at the moment with it
