Someone on G+ pointed out it was a ship not a boat....

So I pointed out that "Shippy McShipface" is too easily misheard and could get you arrested under section 5 of the public order act  ;)

Nof true.  The simple definition of ship is "a large boat."  Many people simply assume there's a size limit to what constitutes a boat.  There isn't.  So, a ship is a boat but a boat isn't necessarily a ship. ;)

Also, I'm glad I don't live in a place where you can be arrested for saying "s***face" in public. :P

It's not quite that simple .. the swearing has to be "interpreted" as threatening and abusive too, and you can only be arrested if you continue to be abusive after being warned to stop by a police officer .. but yeah "section 5" allows our police very broad and often misused powers.

So I guess you'd need to be English, and for "Shippy McShipface" to be misheard by an overly sensitive Scottish police officer before it could be misconstrued as an offence :))

Also .. I'm glad I don't live in a place where you can get shot by that same police officer :P
(or tackled to the ground for simply crossing the road ::) )

There are literally thousands of police departments in this country *not* doing anything untoward.  However, alas, they don't make the news.  However, one or two police departments do some f-d up stuff and people think that's indicative of the entire country.  (understandable, as you haven't been told otherwise)  Well, it's not.  For the most part, police over here protect and serve.  The most average citizens have to deal with is speeding tickets.  And, that's still their bad as they're committing a crime.

I'm not saying police over here are perfect.  Far from it.  There are individuals and even whole departments who are problems, as is the case anywhere.  However, they are the exceptions rather than the rule.  The problem is, cops doing nice stuff usually makes the local news, at best.  The bad apples always make the big news.

As far as I know, even in California you can't be arrested for cussing at someone.  You can even cuss at the cops, politicians, whoever.  As long as there's no threat there's nothing illegal about it. (freedom of speech, and all that)

I know there are exceptions.  (I *do* live here after all)  However, profanity isn't one of them, or at least not one that's enforced in most public places.  For example, a business owner may ask you to leave if you're cussing up a storm.  If you don't leave, you can be arrested for trespassing.  However, you won't be charged with cussing.  Of course, cussing in court could get you contempt of court, etc.

My point is in BOTH our countries "freedom of speech" exists only as a carrot .. they have plenty of sticks they can bat it away with whenever it suits.

Section 5 isn't in itself a law prohibiting profanity (which "theoretically" isn't illegal over here either) .. but......

In reality the only (most likely ?)  time you're going to get arrested over here under section 5 is when the police use it inappropriately to get you to do something they really don't have the power to do .. such as "move you on", refuse or swear (and they'll bait you) and "you're nicked, section 5" so moved on anyway .. as I said it's a VERY broad (and open to interpretation) power that's often misused, so I'm not defending it ;)

I have no doubt your police have some similar "catchall" power.. they always do ::)

Yeah, no doubt.  I can't think of any offhand, but I'm sure they exist.  But then, I keep my interactions with the police to a minimum.  ;)
