 :-\ only when i reboot the laptop will mint update actually detect that there are up dates?
can someone help me figure out why?

Hi iamesperambient, long time no see, how's it going bud?  Have you tried switching back to the old Ubuntu Update Manager to see if that works?  You can run both updaters side by side if you want.  Or, remove the the Mint Update Manager.

apt install update-manager
If that works, I'd remove the Mint Update Manager.

apt remove --purge mintupdate
You can always reverse the process to see if reinstalling the, Mint Update Manager brings it back to life.  A reminder that Peppermint Six is slated for release on 1st June 2015.  That's a date to put in your calendar  ;).
